Background

The client is a long-standing Amazon cross-border seller whose principal product line is color-changing lighting, with more than one hundred active listings. The complainant submitted a patent infringement complaint to Amazon asserting two U.S. utility patents, and all of the client's related listings were removed. With the delisting bearing directly on sales, the client engaged LawMay immediately.

LawMay's Approach

After taking the matter, LawMay attorneys conducted a full technical analysis of the two asserted patents, comparing the scope of the claims against the actual construction of the client's product limitation by limitation. Two parallel lines of defense emerged, and the firm submitted a complete appeal to Amazon's legal team together with five supporting exhibits.

I. Non-Infringement as a Matter of Physics

Every independent claim of the two asserted patents requires an electronic circuit that receives user commands by detecting a sequence of power fluctuations at the wall switch, together with a memory circuit that stores the color-temperature state. Color temperature on the client's product is adjusted entirely by a mechanical DIP switch on the fixture itself; the product contains neither circuit. On the basis of that fundamental physical difference, the team advanced the central contention that the client's product cannot infringe as a matter of physics, supported by three forms of physical evidence: the complete circuit schematic; the official English-language user manual (which directs the user to "rotate the dial switch" to adjust color temperature and states that the product is "not compatible with dimmers"); and operational video showing that repeatedly toggling the wall switch has no effect whatsoever on the product's color temperature. The three categories of evidence corroborate one another from different angles and foreclose the possibility of infringement.

II. The Complainant's Retreat in Federal Court

LawMay attorneys further noted that, in the weeks before the appeal was submitted, the complainant had unilaterally and voluntarily dismissed its district court actions asserting the same two patents — actions naming the client, its co-defendants, and Amazon itself. Neither dismissal involved any settlement, license, or compensation. That the complainant, having initiated complaints at the platform level, withdrew when faced with a neutral judicial process further undermined the credibility of its patent assertions as a matter of litigation conduct.

Outcome

Following submission of the appeal, Amazon restored more than one hundred of the client's affected listings, returning the products to normal sale and achieving the client's objective by the most efficient available route.

The core of this matter was translating complex circuit-level technical facts into a non-infringement conclusion that Amazon's reviewers could evaluate directly. Through precise claim construction and technical comparison, LawMay attorneys reduced the abstract proposition that infringement was "physically impossible" to an evidentiary chain that could be verified item by item, and combined it with the complainant's retreat in federal litigation to build a defense spanning both the technical and litigation dimensions.
