Declaratory Judgment Actions: An Amazon Cross-Border Seller's Affirmative Counter-Measure

TL;DR
Platform appeals cannot decide whether a patent is valid. A declaratory judgment action moves that question to a federal court — and, paired with a TRO, can restore listings before judgment.
For Amazon cross-border sellers, an infringement complaint usually means the same thing: the product comes down and sales stop. Many sellers turn first to the platform's internal appeal process, and the results are often disappointing.
The reason is not complicated. Amazon's primary concern is limiting its own legal exposure, not adjudicating whether a complaint is substantively sound. In patent disputes especially, a platform will not step into the role of a court and decide whether a patent is valid. Even where a seller holds some invalidity evidence, absent an authoritative ruling the platform will tend to leave the listing down to avoid risk.
That is precisely the role a declaratory judgment action fills.
I. What Is a D.J. Action?
A declaratory judgment ("D.J.") action is authorized by 28 U.S.C. § 2201.
The core logic: rather than waiting passively to be sued, the seller sues first in federal court, asking the court to declare that it does not infringe, or that the asserted patent is invalid.
Once such a ruling issues, Amazon has a formal basis on which to restore the listing — an outcome the platform appeal process cannot supply.
II. When Is a D.J. Action Worth Considering?
The following circumstances generally warrant assessing a D.J. action:
- The other side has sent a specific demand letter on a specific patent, and that has already produced concrete platform action such as a takedown.
- The platform's internal appeal process has been exhausted without result.
- The other side declines to file suit and instead applies pressure through continued complaints.
- The complainant is an NPE (a patent assertion entity) using the threat of litigation to extract settlements.
- Multiple sellers are being targeted by the same entity.
- Any other situation involving a genuine patent dispute where the seller has substantive grounds to believe there is no infringement.
III. The Advantages of a Seller Bringing a D.J. Action
1. Control over the pace of the dispute
The platform complaint mechanism puts a seller in an entirely passive position: the timing of the takedown, the appeal window, and the outcome are all determined by the platform and the complainant. A D.J. action changes that structure. As plaintiff, the seller decides when to sue, where to sue, and on what claims — converting a defensive posture into an affirmative one.
2. Choice of forum
As plaintiff, the seller has the choice of forum, and may select a federal district relatively favorable on procedure, cost, and geography — rather than defending on the other side's home ground.
3. Court-ordered relief that addresses the platform problem at its root
The ceiling of a platform appeal is reinstatement of the listing. The object of a D.J. action is a judicial ruling — a declaration of non-infringement, or of invalidity. That ruling is authority Amazon can rely on directly, and it helps foreclose the complainant from asserting the same right again.
Worth emphasizing: within a D.J. action, the seller may also apply for a temporary restraining order. On the same logic by which a patent owner uses a TRO to take listings down, a seller as plaintiff may ask the court to order the other side to cease its complaints and to restore the listings. Where a court grants that relief quickly, products can return to sale well before final judgment. That mechanism matters most in the run-up to a peak season, and it is among the faster paths to relief.
4. Changing the other side's cost structure
A platform complaint is nearly costless. Federal litigation is not: the other side must retain litigation counsel, participate in discovery, and submit the patent's validity to formal scrutiny. For an NPE whose business model is the complaint itself, the cost of defending may far exceed its expected return. In practice, some complainants voluntarily dismiss after being served, or accept settlement terms favorable to the seller.
5. Pursuing bad-faith conduct
A D.J. action is not purely defensive. Within it, a seller may bring counterclaims seeking damages for abuse of the intellectual property complaint process, false statements, or commercial disparagement. The availability of that option is itself a meaningful deterrent.
IV. LawMay's Experience
