Risk Alert | Your Product Has a UL Test Report — So Why Is It Being Delisted and Sued for UL Trademark Infringement?

TL;DR

A test report shows a product meets a technical standard. It does not grant any right to use the UL mark. The two are separate compliance systems, and conflating them is what produces these disputes.

In recent U.S. cross-border e-commerce compliance matters, LawMay has seen a number of situations involving UL trademark infringement suits, TROs, and delistings. The disputes share a highly consistent risk structure: the products have typically completed third-party UL testing and meet the applicable technical standards, but the seller, misunderstanding the legal character of "UL," has used the UL mark improperly in product presentation or marketing, or created confusion as to source — prompting enforcement by UL, by Amazon, or by competitors. This risk is reasonably widespread in cross-border e-commerce and deserves close attention.

I. "UL" Is Not a Neutral Technical Term — It Is a Company's Trademark

In practice, some sellers treat a "UL standard" as a neutral concept akin to a national or industry-wide specification, overlooking that UL is itself a commercial entity. UL's name and logo are protected trademark assets, and its testing standards, certification system, and trademark usage rules are administered and licensed by UL as the rights holder.

In matters we have handled recently, many sellers reported never having realized that UL is a company name rather than a generic technical standard. That misapprehension is reasonably common and is a significant cause of these disputes.

II. Platform Compliance Requirements Are Not a Trademark License

When selling certain electronic products on Amazon and similar platforms, sellers are typically required to provide test reports showing conformity with applicable U.S. safety standards. Commissioning UL to test to a UL standard and obtaining a report is one common compliance path — but not the only one. Engaging another third-party laboratory recognized by the platform or commonly used in the industry is ordinary commercial practice and satisfies Amazon's listing requirements.

But the purpose of platform compliance review is to verify that a product meets safety standards. It does not confer any right to use the UL mark or any UL listing status.

III. The Legal Limits of a Test Report

A report obtained after testing serves only to show that the product met the applicable technical standard under specified test conditions.

Such a report does not authorize use of the UL trademark, nor does it constitute certification, endorsement, or confirmation of any commercial association by UL.

A test report addresses product safety compliance — not brand authorization or certification status.

IV. Use of the UL Mark Requires an Independent License

Absent express authorization from UL, the UL mark must not be used in any commercial context, and no statement may be made that is likely to lead the public to believe the product is UL certified or listed, or is associated with UL — including on the product itself, on packaging, on detail pages, in marketing images, or in promotional materials.

Even where a product has passed testing to a UL standard, unauthorized use of the UL mark, or conduct sufficient to cause confusion as to source, may constitute trademark infringement and expose the seller to enforcement — including trademark and unfair competition claims and litigation — by UL, Amazon, or competitors.

V. A Common Misconception in Compliance Programs

In practice, testing compliance and trademark compliance are two independent systems.

Even after investing in testing and obtaining a UL report, a seller may still face infringement liability for improper use of the mark. That risk does not arise from product quality; it arises from a misjudgment about UL's legal character and the boundaries of compliance.

VI. Response and Compliance Recommendations

If the UL logo or related statements already appear on product pages, packaging, or marketing materials, conduct a compliance review immediately and remediate.

If a letter or notice has already been received from UL, assess the legal risk promptly, take corrective measures, and obtain professional judgment on the compliance path forward.
