Four Days to Turn It Around: LawMay Breaks a Schedule A Design Patent Sweep for Eight Cross-Border Sellers

TL;DR

A TRO froze dozens of sellers' accounts in a vanity-table design patent sweep. Eight engaged LawMay; two days later the motion to dissolve was filed, and two days after that the plaintiff dismissed.

On April 2, 2026, the U.S. District Court for the Northern District of Illinois issued a temporary restraining order in a Schedule A design patent action concerning vanity tables. Dozens of cross-border e-commerce sellers named as defendants had their platform accounts frozen and their products delisted across the board.

For sellers who depend heavily on online channels, an account freeze and delisting means sales fall to zero instantly. More damaging still is the decline in ranking and search weight — the longer it lasts, the higher the cost of recovery and the more imminent the risk of a cash-flow break.

LawMay's Rapid Intervention

On April 13, eight of the defendant sellers engaged LawMay P.C.

The team immediately opened two lines of review:

  • a validity search and prior art comparison on the asserted design patent, to locate the weak points in the rights basis; and
  • an analysis of the accused products in each defendant's store and development of non-infringement positions, to define each client's available defenses.

Within two days, LawMay attorneys completed a Motion to Dissolve the TRO.

The motion was filed with the court on April 14 (U.S. time). On April 16 (U.S. time), the plaintiff filed a notice of voluntary dismissal.

From formal engagement to the plaintiff's abandonment of the case: under four days.

Outcome

For the eight clients, the immediate legal consequence of the dismissal was that the TRO underpinning the account suspensions and delistings lapsed.

LawMay contacted the platforms promptly and assisted the clients in initiating store and product reinstatement, limiting as far as possible the erosion of ranking, the decay of advertising weight, and the interruption of cash flow.

Observations on Schedule A Matters

First, a Schedule A case does not mean settlement is the only option. Where the plaintiff's patent rights basis is flawed, or the defendants' products differ from the asserted claims or design, filing a motion to dissolve the TRO is often far better value than entering settlement negotiations without assessment.

Second, the timing window is acutely sensitive. The first two weeks after a TRO issues are usually the best window to lift the freeze and limit collateral platform effects; the longer it drags, the harder the cascading losses in ranking and cash flow are to recover.

Third, counsel's involvement is itself leverage. A persuasive responsive filing forces a plaintiff to recalculate its likelihood of success and its litigation cost.

That is especially so under the Schedule A model, where a plaintiff typically sues dozens or even hundreds of defendants at once. The commercial logic is mass pressure and rapid settlement; the plaintiff does not expect to litigate a genuine patent case against each defendant.

Once a well-prepared, concentrated response appears among the defendants, the economics of that model are directly undermined — continuing not only becomes unlikely to yield the expected settlement, it exposes the patent itself to challenge.

Closing

The U.S. litigation environment facing cross-border e-commerce is growing more complex, with intellectual property actions of every kind. For Chinese sellers, entering the process affirmatively and seeking judicial relief with counsel experienced in U.S. litigation is what actually opens up a matter.
