Recently, Attorney Deng’s team successfully represented a client in a Schedule A trademark infringement case filed by a renowned American apparel brand against an Amazon seller. At the critical moment when the client was facing the risk of huge compensation due to a default judgment, Attorney Deng’s team, through efficient settlement negotiations, successfully assisted the client in reaching a settlement with the opposing party, and the settlement amount was far lower than what the client had expected.
At the early stage of the case, the client attempted to negotiate a settlement with the plaintiff through other channels. However, no agreement was reached for a long time, and neither was a lawyer retained to represent the client in filing a defense or applying for an extension of time.
Consequently, the two parties not only remained in sharp disagreement over the settlement procedure, but also, upon the expiration of the response period, the court entered a default judgment against the client.
Once this default judgment takes effect, the plaintiff will be entitled to apply to Amazon for enforcement, directly deducting funds from the client's frozen Amazon account to cover the unreasonably high amount of compensation awarded in the judgment.
