Recently, Attorney Deng's Team successfully represented the patentee in issuing a legal demand letter and filing a complaint in connection with a patent infringement incident involving a cross-border e-commerce platform. This prompted Amazon US to officially take down the links to the relevant infringing products, thereby swiftly safeguarding the client’s patent rights and commercial interests.
After accepting the entrustment, the team promptly conducted an infringement analysis. Based on a detailed comparison between the claims of the involved patent and the suspected infringing products, it was initially confirmed that the relevant products were highly likely to constitute infringement. Guided by professional judgment, the team immediately formulated and launched a rights protection plan.
During the initial rights protection phase, the team submitted multiple claims of right through Amazon’s online infringement complaint channel. However, as the platform’s online complaint mechanism was unable to fully present the details of technical comparison, the complaint failed to progress smoothly.
In light of this, the team promptly adjusted its strategy and further initiated offline rights protection measures by sending a legal demand letter to Amazon’s Legal Department. The team purchased the allegedly infringing products for physical comparison, and issued a detailed legal opinion based on the comparison results.
The formal complaint materials elaborated on the comparison between the technical features of the patent claims and those of the accused products, and fully demonstrated the facts of infringement. Ultimately, Amazon recognized the professional opinions submitted by the team and decided to take down the relevant infringing links.

This case was handled jointly by Deng Hongchang, a lawyer licensed to practice in both China and the State of California (U.S.), and Xiao Xinyan, a trainee lawyer. By accurately grasping platform rules and flexibly applying legal strategies, the team helped the client achieve efficient remedy of patent rights, demonstrating the important value of professional legal services in the protection of intellectual property in cross-border e-commerce.
