LawMay recently achieved a significant milestone in a high-stakes intellectual property dispute involving an Amazon seller targeted by malicious patent infringement claims. In a declaratory judgment action filed in the U.S. District Court for the Western District of Washington, our team successfully secured both a Temporary Restraining Order (TRO) and—in a notable development—a “Reverse” Preliminary Injunction (PI) against the patent holder.
This case involved an Amazon store wrongfully accused of patent infringement by a U.S. patent owner. Through diligent pre-litigation investigation and strategic legal advocacy, LawMay swiftly obtained a TRO within ten business days of filing, halting the baseless complaints and restoring the client’s product listings promptly.
Building on that success, the firm later persuaded the court to issue a Reverse Preliminary Injunction—a rare and impactful ruling that prohibits the patent owner from filing any further infringement complaints against our client based on the asserted patent. This order provides critical stability to the client’s sales channels and reinforces their position in the marketplace.
The granting of a Reverse PI is particularly noteworthy given the court’s historically cautious approach to such remedies. Through thorough legal briefing and effective oral argument, LawMay demonstrated both a likelihood of success on the merits and the risk of irreparable harm, ultimately securing this exceptional relief.
To their knowledge, this ruling represents one of the first instances in recent years where the Western District of Washington has issued a Reverse Preliminary Injunction in a case of this nature. This outcome may signal a growing judicial willingness to address misuse of intellectual property claims in e-commerce platforms, setting a persuasive precedent for future matters.
This case exemplifies the firm’s commitment to defending online sellers against wrongful accusations and platform-based IP abuse. From initial takedown to full restoration and proactive protection, they provide end-to-end legal support to help clients navigate complex cross-border disputes.
