Richard Deng
Hongchang "Richard" Deng (Partner) is a partner at LawMay P.C., admitted to practice in both China and the United States (California), with rights of audience before federal district and appellate courts in multiple U.S. states. He focuses on cross-border intellectual property and U.S. federal litigation — in particular Amazon TRO / Schedule A defense for cross-border e-commerce, ITC Section 337 investigations, product liability, and trade secret disputes.
Biography
Mr. Deng's practice centers on the resolution of goods- and services-related disputes in China and the United States, together with foreign-related IP litigation and invalidity/validity proceedings concerning patents, trademarks, copyrights, and trade secrets, as well as U.S.–China trademark filings and Chinese patent applications. He serves cross-border trade and manufacturing enterprises, cross-border e-commerce sellers, the vape industry, and technology manufacturers on an ongoing and project basis, acting for Fortune 500 companies, international chain brands, and overseas-expanding technology brands, among other well-known Chinese and international clients.
In cross-border e-commerce disputes, Mr. Deng concentrates on defending sellers named in Schedule A mass litigation — including unfreezing store accounts and funds held under temporary restraining orders (TROs); restoring delisted product listings and store operations through declaratory judgment (DJ) actions and "reverse TRO" motions; and handling platform disputes such as Amazon account-freeze appeals and Brand Registry disputes. In the Western District of Washington, he has represented sellers in numerous DJ actions, obtaining "reverse TROs" and "reverse preliminary injunctions" that restored listings and barred the opposing party from further complaints. He is familiar with the procedural rhythm of the Northern District of Illinois, the Southern District of Florida, and other courts where Schedule A cases are concentrated, and responds quickly across the U.S.–China time difference to seize the window for defense and settlement.
In the foreign-related vape and FDA regulatory area, Mr. Deng provides full-cycle representation for vape and next-generation tobacco companies — from rights establishment and compliance through enforcement — covering industry IP enforcement and Section 337 investigations, PMTA premarket applications and STN status disputes, FDA enforcement defense (warning letters, marketing denial orders (MDOs), and Import Alerts), and U.S. Customs (CBP) clearance compliance and detained-goods appeals.
Cases he has handled have repeatedly been recognized among professional honors, including "Guangdong Province Typical Cases of Administrative IP Protection," "Guangdong Province Trade Secret Protection Milestone Events," "Top Ten Typical IP Cases Handled by Shenzhen Lawyers," "Shenzhen Typical Trade Secret Infringement Cases," "Typical Cases by Shenzhen Lawyers in International Trade and Investment," and the "Guangdong IP Protection Association Annual Recommended IP Study Cases."
